This appeal is taken from a conviction for unlawful possession of marihuana in an amount of more than 50 pounds but less than 200 pounds. TEX. REV. CIV. STAT. ANN. art. 4476-15, § 4.051(a), (c), (d)(1) (Vernon 1989). Following the jurys verdict of guilty, the court assessed appellants punishment at fifty (50) years confinement in the Department of Corrections, and at a fine of $5,000.00.
